Terms and Conditions

§ 1 Scope of Application
These terms and conditions apply to all online shop purchases from Bellona Cashmere & Horn GmbH, Richard-Wagner-Weg 40, 64287 Darmstadt (hereinafter referred to as Bellona), made by consumers. A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

§ 2 Conclusion of Contract, Storage of Contract Text, Detection and Correction of Input Errors
(1) The presentations in this online shop, other online offers, brochures, circulars, price lists and other product presentations generally do not constitute a binding offer to conclude a contract, unless the specific circumstances indicate otherwise.

(2) Through our online shop, you can make a binding offer to conclude a purchase contract. This is done by selecting a product by clicking the [Add to Cart] button and then clicking the [Checkout] button. After entering your address and payment method, at the end of the ordering process under the "Review and Order" tab, you have the opportunity to review all entries once more and make changes if necessary. Changes can be made by clicking the "change" link for the respective entry or by deleting the ordered item from the shopping cart (trash icon) or by changing the quantity of ordered goods (drop-down menu). By clicking the [Place Order] button, you then make a binding purchase offer.

(3) Your order and the entered order data will be saved in your personal customer account if you register as a customer before or during the order. Using the login credentials that you set yourself during your first registration, you can access your customer account at any time and print your order with all entered data. Additionally, the order can be printed directly after completion on the following confirmation page.

(4) The order confirmation automatically sent after submitting your order merely documents that your offer has been received by Bellona, but does not yet constitute acceptance of your offer.

(5) Bellona may accept your offer by sending an order confirmation in text form, i.e., in a manner suitable for permanent reproduction in written characters, or by delivering the goods within 3 days of receiving your offer.

(6) The contract may be concluded in German.

§ 3 Payment
Payment by the buyer is made in advance by credit card, PayPal, or after receipt of the goods by bank transfer.

Note on purchase on account: For the purpose of deciding on the establishment, execution, or termination of the contractual relationship, we collect or use probability values, in the calculation of which address data, among other things, is included.

§ 4 Payment Default
If you fall into payment default, Bellona is entitled to demand default interest of 5 percentage points above the base interest rate of the European Central Bank per year. If Bellona has suffered a higher demonstrable default damage, Bellona is entitled to claim this.

§ 5 Delivery
(1) Delivery will be made to the delivery address you have provided.

(2) The delivery time is, unless otherwise stated, approximately 1-4 days from the conclusion of the contract.

§ 6 Right of Withdrawal
Consumers have the following right of withdrawal in the event that the contract was concluded exclusively using distance communication means:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Bellona Cashmere & Horn GmbH, represented by Managing Director Dipl.-Kfm. You may use the attached sample withdrawal form for this purpose, but it is not required.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this contract, we must refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which the notification of your withdrawal of this contract was received by us. For this refund, we will use the same payment method you used in the original transaction, unless you have expressly agreed otherwise; in no case will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier date.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods before the expiration of the fourteen-day period. You bear the direct costs of returning the goods. You are only responsible for any loss in value of the goods if this loss of value is due to handling of the goods that is not necessary for inspecting the condition, properties, and functionality of the goods.

§ 7 Retention of Title
Until full payment of all claims against you arising from the purchase contract, the delivered goods remain the property of Bellona. As long as this retention of title exists, you may neither resell the goods nor dispose of them.

§ 8 Defects / Liability for Defects
The statutory provisions on liability for defects apply.

§ 9 Contract Language, Applicable Law
The contract language is German. The contract concluded between you and Bellona is governed by the law of the Federal Republic of Germany.

§ 10 Jurisdiction, Online Dispute Resolution / Dispute Settlement for Consumers
(1) If you do not have your place of residence in the Federal Republic of Germany at the time of order, or if you move your place of residence abroad after conclusion of the contract, or if your place of residence is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from and in connection with the contractual relationship is Frankfurt am Main.

(2) The European Commission has established an internet platform for online dispute resolution. The platform serves as a point of contact for out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts.
